States are already in control of education. It is a power reserved by the States under the Constitution. The Federal government hands out some money and enforces Title 9.

That was not a legislative or executive action, that was the Supreme Court ruling that the Constitution was being violated. To paraphrase, it is a Constitution they are expounding, not education.
