If they were to not file an asylum application, then yes they would be illegal immigrants to the US, but if they were going to report to the authorities and file an asylum application, what they were doing is legal under international law and is just one of the ways to seek asylum in the US.

It seems to me that the end date is a bit inaccurate. While I agree with some other comments of the talk page about it having "fizzled out", it was still ongoing well into January and is atleast technically still ongoing.
