Rationale for fair use in article Tenacious D[edit]

This picture is being used in Wikipedia's article for the rock band "Tenacious D". Although it is subject to copyright, the D editors of Wikipedia, among them myself (Tenacious D Fans) in particular, feel that it is covered by US fair use laws because:

It is a small part of the audio file, with under 30 seconds of it.
It is used here for purely encyclopedic and informational purposes.
It does not harm the copyright owner commercially.
