      • If you try to repost a previously deleted file, then Mediawiki complains. You can override the warning if you're using the standard upload form, but maybe Flickr2Commons lacks that feature. Files could be deleted as Flickrwashing, as a derivative work or whatever, and it's best to go through c:COM:UDR if you want the file undeleted.

User:Hammersoft, who nominated the file for deletion on Commons, questioned whether the uploader was the copyright holder, so was the original upload tagged as "own work by the uploader"? The Flickr account looks credible: it's from 2008 and has thousands of picture and thus difficult to fake, but I don't find any link from the company's website to the Flickr account. --Stefan2 (talk) 21:04, 7 March 2018 (UTC)

• Chiming in here as pinged. The file on Commons was the only upload by the editor on Commons. The image on Commons was from https://secondstory.com/studios, which does not have a license compatible with Commons. Note that the upload to flickr occurred a month after the deletion discussion on Commons closed as delete. Thus, the image at the time truly wasn't available under a license compatible with Commons. If the company can be shown to be the owner of that flickr stream (which does seem to be the case), I've no objections, as it is licensed appropriately for Commons from that stream. --Hammersoft (talk) 21:16, 7 March 2018 (UTC)

I'm inclined to decline this request. This person is apparently notable primary for their military service, and so the likelihood of there existing a public domain image created by the US government seems to be high. I'm not totally comfortable that not having found one yet is sufficient to justify the use of an Associated Press image. In fact, since the Iwo Jima image includes the person, and is pretty easily fair use as a unique historically important image, I'm not sure that alone doesn't cause problems with uploading an additional fair use image according to the non-Free content criteria.

I don't think we have a good assurance that in the 40s , the military routinely photographed soldiers, and if they did, if those records still exist. (today, yes). That said: this image is non-free. It is apparently from the Smithsonian Channel. I also see a second image [1] that is also from the Smithsonian Channel. We are allowed to use non-free for deceased people, and this seems like a clear allowance. --Masem (t) 15:11, 5 April 2018 (UTC)

Just because it says Associated Press doesn't mean that they are the copyright holder. Much in the same way people can say "Taken from Wikipedia". All photos taken by federal employees in the course of their duties have been PD since 1976 (retroactive to all photos). However, Masem is correct. It really doesn't matter if it is {{PD-USGov}} since it would qualify for fair use under {{non-free biog-pic}}. I'm personally inclined to believe that this is an official government photo taken during the time of his service but without proof it would be safer to just fair use it. --Majora (talk) 00:10, 6 April 2018 (UTC)

QG...dude, you've been here for 12 years, you have as many main space contributions as I do, and you have 20 images uploaded on Commons already. Just...go upload the images. This is part of the Articles for Creation project, mostly for new editors who don't know how to properly formulate a non-free use rationale. I don't understand why you are so reticent to upload something yourself. I mean, I don't mind helping out, but..."upload these dozen files" is a little excessive for someone who knows how to upload files. GMG^talk 13:27, 23 April 2018 (UTC)
