Yes, I'm aware of that. But just because someone puts on a uniform and someone else takes a picture doesn't mean it was taken by a member of the US military in the course of their duties (the bar required for that license). Official military photographs tend to have the US flag in the background which is why this particular photo gave me pause. --Majora (talk) 23:09, 11 March 2017 (UTC)

Copyright protections still apply regardless of how it is published unless there is an explicit notice that releases the item under a different license. In this case, that album cover is still very much copyrighted under an "all rights reserved" license and therefore we can't use it. We also can't place it under "fair use" since the request is for the main artist's article. That would not fit within our fair use policy.
